Terms of Service

These Terms of Service ("Terms") govern your use of the Remap apps and website (the "Service"), provided by Remap Earth Pty Ltd (ACN 699 334 793), of 202, 255 Castlereagh Street, Sydney, NSW 2000, Australia ("Remap", "we", "us", "our"). By using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Eligibility

You must be at least 16 years old to use the Service. By using it, you confirm that you are 16 or older and that you can form a binding contract with us. If you are under the age of majority where you live, you should review these Terms with a parent or guardian.

The Service

Remap builds routes from your preferences, records the rides you take, and runs a territory game in which roads you ride become territory you can hold, lose, or contest with other players. Features may change over time.

Your account

You sign in through Google or Apple. You are responsible for activity under your account and for keeping access to your sign-in provider secure. Provide accurate information and use the Service only as permitted by law and these Terms.

Acceptable use

• Don't misuse, disrupt, overload, or attempt to gain unauthorised access to the Service.
• Don't submit falsified or fabricated rides, or otherwise manipulate the game, territory, or leaderboards.
• Don't upload content that is unlawful, infringing, or that you do not have the right to share.
• Don't scrape, resell, or reverse-engineer the Service except to the extent the law permits.
• Don't use the Service for any unlawful purpose or in a way that endangers yourself or others.

Your content

You retain ownership of the rides and routes you create or upload ("Your Content"). You grant us a non-exclusive, worldwide, royalty-free licence to host, store, process, reproduce, and display Your Content as needed to operate and provide the Service to you, including generating share previews for links you choose to create. You are responsible for Your Content and confirm you have the right to share it. We may also use anonymous, aggregated, and de-identified data derived from activity on the Service, as described in our Privacy Policy.

Sharing rides

If you create a share link, that ride becomes accessible to anyone who has the link, without signing in, and its route may reveal the actual GPS track you rode. Only share rides you are comfortable making public. You can revoke a share link at any time.

Territory and the game

Territory, lines, levels, experience, and other in-game elements are virtual, have no monetary value, and cannot be redeemed, transferred, or exchanged for money or anything of value. We may adjust the game's rules, scoring, balance, and territory at any time, and we may reset or remove game data to maintain the integrity of the game.

Subscriptions and payments

Parts of the Service are free. We may offer paid subscriptions or other paid features. If you purchase a subscription, the following applies.

• Purchases and billing are handled by the app store you buy through (such as the Apple App Store or Google Play), subject to that store's terms. We do not receive or store your full payment details.
• Subscriptions renew automatically at the then-current price until cancelled. You can manage or cancel a subscription in your app store account settings, and cancellation takes effect at the end of the current billing period.
• We will give reasonable notice of any price change before it takes effect. Continuing your subscription after a price change means you accept it.
• Refunds are handled by the app store under its refund policy. Nothing in this section limits any rights you have that cannot be excluded under the Australian Consumer Law or other applicable law.

Ride safely

Routes and navigation are suggestions, not instructions. Roads, conditions, and access change, and our data may be incomplete or inaccurate. You are solely responsible for your own safety: obey all traffic laws, ride within your ability, stay aware of your surroundings, and do not interact with the app while it is unsafe to do so. We are not responsible for any accident, injury, or loss arising from your use of the Service, except to the extent it cannot be excluded by law.

Third-party services

The Service relies on third parties, including your sign-in provider, your app store, and mapping and hosting providers. Their services are governed by their own terms, and we are not responsible for them.

Intellectual property

The Service, including its software, design, maps, and content (excluding Your Content), is owned by Remap or its licensors and protected by law. These Terms grant you no rights to our trademarks or branding.

Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that applies to you and cannot lawfully be excluded. Where our liability for failing to comply with a consumer guarantee can be limited, it is limited (at our option) to re-supplying the service or paying the cost of having it re-supplied.

Disclaimers

Subject to the Australian Consumer Law and any other rights that cannot be excluded, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, and subject to the Australian Consumer Law, Remap will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. To the extent our liability cannot be excluded but can be limited, our total liability is limited to the greater of the amount you paid us for the Service in the 12 months before the claim, or AUD 100.

Assumption of risk, waiver, and release

Remap helps you plan and record outdoor activities such as cycling, running, and walking (the "Activities"). You understand and accept that the Activities carry inherent risks, and that these risks can lead to property damage, loss, serious injury, illness, or death. Those risks include, for example, road and trail conditions, terrain, weather, darkness, altitude, traffic, the actions of other people, equipment failure, your own physical condition, and other hazards that are part of being active outdoors.

By using the Service you voluntarily assume all such risks and take full responsibility for your own safety and decisions, including whether to wear a helmet or other protective equipment. To the fullest extent permitted by law, you release and discharge Remap and its directors, officers, employees, contractors, and licensors from any claims, actions, or losses for injury, illness, death, property damage, or other loss arising out of or relating to the Activities or your use of the Service, including where caused by our negligence. Nothing in this section excludes or limits any right or remedy you have that cannot lawfully be excluded, including under the Australian Consumer Law.

Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Remap and its directors, officers, employees, contractors, and licensors from any claims, demands, losses, liabilities, and expenses (including reasonable legal fees) arising out of or relating to your use of the Service, Your Content, or your breach of these Terms or of any law or the rights of another person. This does not apply to the extent a claim results from our own breach of these Terms or from liability that cannot be excluded by law.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, or where reasonably necessary to protect the Service or other users.

Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and revise the "Last updated" date above. Continued use of the Service after changes take effect means you accept them.

Governing law

These Terms are governed by the laws of New South Wales, Australia, and you and Remap submit to the non-exclusive jurisdiction of the courts of New South Wales, without regard to conflict-of-laws rules.
